Did you pay using Paypal? If so ring them immediately and tell them what has happened. I think Ebay's buyer protection is pretty effective.
If you didn't use Paypal ring your local Citizens Advice Bureau. Yours will not be the first case of this nature and they will be able to tell you exactly what your rights are.
Consider also the small claims court.
The person who sold you the

Olympus E-520 + Zuiko Digital 40-150 f3.5-4.5 +extras

has now got an 18 positive Ebay feedback.

Hi Steve

I'm pretty confident it will work out OK (famous last words?).

It used to be a case of going through Paypal, but now I think it is normally sorted out on the Ebay side.

Not been a good week as someone seems to have lifted an E3 I was getting from someone on the forum here, but that's another story.

Unless the item was advertised as having a fault, he can't deny your right to return it. But of course you wouldn't want to return ut until you were guaranteed a refund.

It's actually a criminal offence in some circumstances to advertise something 'as seen' too but that's probably a different debate...

Just an update.
The seller (obee71) insisted that it was OK and blamed me for the fault.
Escalated the claim last week and Ebay sent me a return postage label last friday. Posted the kit on Tuesday (lucky as it had to be posted within 5 days).
They found in my favour (as i thought they would) and I have today received a full refund from Ebay/Paypal.
Excellent.
I think it is a case of seller beware on Ebay.
